Hewlett-Packard Faces French Suit Over Alleged Contract Fraud – 2009-05-20 12:41:31.879 GMT

May 20 (Bloomberg) — Hewlett-Packard Co., the world’s
biggest personal-computer maker, was accused by a former
subcontractor of using a fake letter to mislead a judge in a 13-
year-old French dispute over an unpaid bill.
Hewlett-Packard faces a criminal trial in Caen, France,
over the allegations by Marc Crozet, former manager of the
software contractor, CJM Group. The judge leading the criminal
probe had recommended dropping the case, a decision reversed by
the Caen appeals court’s investigation division.
“The fact that the document was a forgery was never
proven, and the letter has nothing to do with the contract
dispute,” said Alain Spitzmuller, in-house counsel for Hewlett-
Packard in France, in a telephone interview. “Hewlett-Packard
from the very start said that this document is genuine.”
An almost five-hour long hearing ended late last night,
Crozet said. The ruling at the Caen criminal court, expected
July 8, could pave the way for a separate claim for 15 million
euros ($20.5 million) in damages, he said.
Crozet originally sued Hewlett-Packard for refusing to pay
now-defunct CJM for work it did for Sernam SA, then part of
state-owned railway operator Societe Nationale des Chemins de
Fer Francais, or SNCF.
“If there’s a favorable judgment for us in the criminal
court, it will have very serious consequences also for the
parallel commercial dispute, which has been put on hold, where
several million euros are at stake,” said Crozet by telephone
today.
During the commercial dispute, Hewlett-Packard produced a
letter in February 2001 allegedly from Sernam saying CJM
couldn’t do the work. That letter was a fake, Crozet said.
Hewlett-Packard won the initial case over the contract’s
termination in a 1999 decision which found it “had fulfilled
its commitments” to CJM. Crozet appealed, and the letter was
produced as part of that matter.
